Coldspring to clean up right of way issue

COLDSPRING — An old county right of way ordinance will need changes in order for new owners of a gas station.

Mayor John Benestante said that at the Oct. 7 City Council meeting, attorneys for the new owners of the station found that during a title search, a 1931 ordinance was passed granting San Jacinto County a 100-foot right of way.

The property in question was later annexed by the city of Coldspring, so the attorneys approached the city about an amendment to the ordinance.

Benestante said the city attorney is now working on an amendment to change the right of way to 30 feet, which will be discussed at a special meeting at the end of this month.

In other business, the council:

• reappointed William Baker to represent San Jacinto County incorporated municipalities;

• amended the budget for the Resilient Communities Program grant fund;

• amended the city budget to add a line item for second vehicle for the Public Works Department;

•added line items to the budget for the Community Center;

• agreed to join with San Jacinto County for animal control; and

• approved an interlocal agreement deeding Live Oak Street to the county.
