POLK COUNTY, TEXAS NOTICE TO DEFENDANT: You have been sued. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 am on the Monday next following the expiration of 42 days after the date this citation was issued, a default judgment may be taken against you. In addition to filing a written answer with the clerk, you may be required to make initial disclosures to the other parties of this suit. You are hereby commanded to appear by filing a written answer to the Plaintiff ’s Original Petition at or before 10:00 o’clock A.M. on the Monday next after the expiration of 42 days after the date of issuance of this citation the same being Monday August 19, 2024 before the Honorable 411th District Court of Polk County, at the Courthouse in said County in Livingston, Texas. Said Plaintiff ’s Original Petition was filed in said court June 25, 2024 in the above entitled cause. A brief statement of the nature of this suit is as follows, to-wit: This action concerns title to real estate described in a General Warranty Deed to Plaintiff ’s predecessors in interest Henry Davis and Gertrude Davis, dated August 7, 1943, recorded in Volume 129, Page 288, et. seq. of the Polk County, Texas Deed Records. The real estate is described as: Being all that certain lot, tract or parcel of land, a part of the M.L. Choate League, in Polk County, Texas, and being a part of that certain 50-acre tract conveyed by W.D. Willis to Jim Moore by Deed dated February 17, 1888, and recorded in Volume X, Pages 101 et seq. of the Deed Records of Polk County, Texas. And is more fully shown by Plaintiff ’s Original Petition TO Trespass to Try Title on file in this suit.
