Grand jury indicts 26 on charges ranging from capital murder to theft

COLDSPRING – Twenty-six indictments were returned by San Jacinto Grand Jury members during the month of September 2007.
Among those indicted is Billy Gene Marshall on charges of capital murder.
Marshall, who is currently incarcerated in Oklahoma on capital murder charges there, was indicted in San Jacinto County Sept. 7 for the Oct. 28, 2004 capital murder of Oscar Davis, according to San Jacinto County Criminal District Attorney Bill Burnett.
Burnett said that Marshall admitted going to the Davis house, located on FM 1127 in Shepherd, to purchase marijuana, but denied going inside the house where Davis’ body was found.
“A hand print inside the house made with Davis’s blood was later identified as that of Marshall’s,” Burnett said.
“I doubt Marshall, 53, will ever be returned to Texas for trial since he is facing capital murder charges in Oklahoma,” Burnett said.
According to the grand jury indictment, Davis was stabbed to death with a knife and an object unknown to the grand jury while Marshall was in the course of committing or attempting to rob Davis.
Four county residents have been indicted on charges of burglary of a habitation. The four are accused of taking a piano, living room furniture, dining room furniture, bedroom furniture, four air conditioners and antique dolls owned by Sandra Fulcher.
Indicted for the April 28, 2007 burglary are James Allen Lewis, 25, Kayla Ann Campbell, 19, Tyler Beaver, 22 and Lillie Harrell Hughes, 45.
In other indictments, Tab Quincey Adams, 44, was indicted Sept. 21 on charges of burglary of a habitation. Adams was arrested Sept. 27, 2006.
Rodney Gilbert, 42, was indicted on charges of possession of cocaine in an amount of less than one gram. Gilbert was arrested Dec. 16, 2006
Scott Joseph Randall, 22, was indicted for the April 9, 2007 family violence assault by causing bodily injury to a member of his family by grabbing and throwing her body and putting his knees in her back.
Michael Eugene buntning III, 32, indicted after being charged with possession of 3, 4-methylenedioxy methamphetamine in an amount of less than one gram. He was arrested Feb. 10, 2007.
Joey Allen Elliott, 30, was indicted on charges of possession of methamphetamine in an amount of less than one gram. He was arrested Feb. 19, 2007.
Christopher Chesson, 29, was indicted for possession of methamphetamine in an amount of less than one gram on charges pending from Feb. 18, 2007.
Richard Clyde Grady, 27, was indicted for tampering with physical evidence. According to the indictment, on Oct. 7, 2006, Grady knowingly concealed a motor vehicle with intent to impair its verity or availability as evidence in an investigation.
Daniel Lee Cornett, 26, was indicted on charges of forgery.
Jeffery Allen Henderson, 32, was indicted on charges of possession of controlled substance (methamphetamine in an amount of four grams or more but less than 200 grams).
J.T. Ellisor, 67, was indicted on charges of aggravated assault with a deadly weapon. According to the indictment, Ellisor threatened Katherine Ellisor with imminent bodily injury by ramming his vehicle into hers, exhibiting a deadly weapon – his motor vehicle – during the commission of the assault. The incident occurred Aug. 15, 2007.
Kenneth James Price, 31, was indicted on charges of possession of a controlled substance, namely methamphetamine in an amount of less than one gram.
Dorothy I. Nettles, 24, was indicted on charges of burglary of a habitation.
Prentice Anderson, 48, was indicted on three counts of theft.
Treska Sha Young, 42, was indicted on charges of securing execution of a document with deception. According to the indictment, Young defrauded the Texas Department of Human Services by failing to report her earned employment income in order to receive food stamp benefits valued at $1,500 or more but less than $20,000.
Benny Vern Burkett, 35, was indicted on charges of driving while intoxicated, third offense, with an open container.
David Joseph Blunt, 33, was indicted on charges of theft of a four-wheeler.
Barrett Bradley Davis, 28, was indicted on charges of driving while intoxicated, third offense.
Paula Jeanette Steiner, 34, was indicted on three county of theft.
Matthew Douglas Walker, 25, was indicted on charges of driving while intoxicated, third offense.
John McGuire, 33, was indicted for the May 4, 2007 theft of a barbecue pit, refrigerator/freezer, four-wheeler and a picnic table.
